1. Introduction

Welcome to CaloGoal, operated by INNOVA GLOBAL DEVELOPMENT S.R.L. ("we," "our," or "us"). By accessing or using our website, mobile application, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Eligibility

The Service is intended for users who are 18 years of age or older (or the age of legal majority in your jurisdiction). By using the Service, you represent and warrant that you meet this age requirement. We do not knowingly permit users under 18 to create accounts or use the Service.

3. Merchant of Record

Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. Lemon Squeezy provides all customer service inquiries and handles returns.

When you purchase a subscription through CaloGoal, you are also entering into an agreement with Lemon Squeezy. Please review Lemon Squeezy's Terms.

4. Free Trial

We may offer a 7-day free trial for eligible new users. Trial eligibility is limited to one trial per user.

Trial Duration: 7 calendar days from the date of activation.
Post-Trial Pricing: At the end of the trial, your subscription will automatically convert to a paid subscription at the price selected during signup:
- Plus Plan: $4.99 per month or $39.99 per year.
- Pro Plan: $9.99 per month or $79.99 per year.
Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date.
Cancellation: You may cancel your trial or subscription at any time before the trial ends to avoid being charged. Cancellation is available through:
- Your in-app Profile → Subscription settings;
- Emailing us at support@calogoal.com;
- The Apple App Store or Google Play Store subscription management (for mobile subscriptions).

5. Subscriptions and Billing

Certain features of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (monthly or annually), depending on the type of subscription plan you select.

Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it.
Cancellation: You may cancel your subscription renewal through your online account management page, by contacting our customer support team, or through your platform's app store.
Refunds: Refunds are governed by our Refund Policy.

6. Use of Service

CaloGoal provides AI-powered nutrition tracking and weight prediction services. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial use.

Acceptable Use

You agree not to:

Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
Harass, threaten, demean, embarrass, or otherwise harm any other user of the Service.
Violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third-party intellectual property right.
Interfere with security-related features of the Service.

7. No Medical Advice

IMPORTANT: The Service is for informational purposes only. The AI predictions, nutritional analysis, and weight forecasts are estimates and should not be treated as medical advice. We are not medical professionals. You should consult with a physician or other healthcare professional before starting any diet or exercise program.

AI Accuracy: AI-generated food analysis and nutritional estimates are approximations. Actual nutritional content may vary based on portion size, preparation methods, and ingredient brands. Always verify critical dietary information independently.

8. User Accounts

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

9. Account Deletion

You may delete your account and all associated data at any time via your Profile settings. Upon deletion, all your logs, personal measurements, and account details are permanently removed from our database. If you need assistance, contact us at support@calogoal.com.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, if you materially breach these Terms. Upon termination, your right to use the Service will immediately cease. We reserve the right to terminate accounts for repeated violations of our Acceptable Use policy or fraudulent activity.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall CaloGoal or INNOVA GLOBAL DEVELOPMENT S.R.L., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of România, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of București, România.

If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these Terms affects your statutory rights as a consumer.

13. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
